Welcome to Swack Vacations. These Terms of Service ("Terms") are an agreement between you and Swack Vacations LLC ("Swack Vacations," "we," "us," or "our") and apply when you use
swackvacations.com, our booking site at swackvacations.guestybookings.com, and our related emails, texts, and social media pages (together, the "Sites"). By using the Sites, you agree to these Terms. If you do not agree, please do not use the Sites.
Our
Privacy Policy and
Cookie Policy explain how we handle personal information and are part of these Terms.
1. Who can use the Sites
You must be at least 18 years old to use the Sites and able to enter into a binding contract. The primary renter on every reservation must be at least 25 years old and must stay at the property for the reservation. No one under 25 may occupy a property without a parent or legal guardian present.
2. Reservations and your rental agreement
Our direct reservations are made through our booking site, which runs on the Guesty platform. Each stay is also governed by the rental agreement, house rules, and property-specific policies shown to you during booking or sent with your confirmation (together, your "Rental Agreement"). These include the property's check-in and check-out times, occupancy limit, pet rules, deposit or damage protection requirements, and cancellation policy.
If these Terms and your Rental Agreement conflict about your stay, the Rental Agreement controls. A reservation is confirmed only when you receive a written confirmation from us, and we may decline or cancel a reservation request for good reason, such as a pricing or availability error, failed payment, suspected fraud, or failure to meet eligibility requirements. If we cancel for one of these reasons before your stay, we will refund amounts you paid us for that reservation.
3. Prices, fees, taxes, and payment
Rates and availability on the booking site are live and change with dates, demand, and length of stay. The total shown at checkout includes the nightly rate and any required fees and taxes for that property, such as cleaning fees, pet fees, and lodging taxes. Prices on swackvacations.com pages, in blog posts, ads, or emails are for general information only; the booking site is the source for current pricing and availability.
Payments are processed by our booking platform's payment processor. You authorize us and our payment processor to charge your payment method for the amounts shown at checkout and for any other amounts due under your Rental Agreement. If we make a clear pricing error, we may correct it before your stay and give you the choice to keep the reservation at the correct price or cancel for a full refund.
4. Changes and cancellations
Cancellation and change rules vary by property and are shown in your Rental Agreement. To request a change or cancellation, contact Renata Beebe at

724-991-7326. No statement on the Sites, in chat, or in marketing materials changes the cancellation terms of your Rental Agreement.
5. Your stay
When you book, you agree for yourself and everyone in your group to:
- stay within the occupancy limit and bring pets only to properties that allow them, following that property's pet rules and fees;
- follow the house rules and the rules of any resort, homeowners' association, or community where the property is located, including guest registration, parking, pool, and amenity rules;
- treat the property, neighbors, and on-site staff with respect and follow local laws, including noise ordinances; and
- report damage or problems promptly, and pay for damage, missing items, or extra cleaning beyond normal use as described in your Rental Agreement.
We may end a stay without refund if guests seriously or repeatedly break the Rental Agreement, put people or property at risk, or exceed the occupancy limit.
6. Property information
We work hard to keep property descriptions, photos, amenities, sleeping arrangements, and destination details accurate and up to date. Even so, furnishings and decor change, photos may show staging or a nearby view from a different angle, and distances are approximate. Shared amenities at resorts and communities (such as pools, lazy rivers, fitness rooms, beach access, and docks) are controlled by those properties and may close for weather, maintenance, season, or local rules. Things outside our control, such as construction, weather, or utility outages, can also affect a stay. If something important to you is not clear, please ask us before you book.
7. Bookings through other platforms
If you book one of our properties through a third-party platform such as Airbnb, Vrbo, Booking.com, Whimstay, Google, or Hopper, that platform's terms, payment rules, and cancellation policies also apply to your reservation, along with our house rules.
8. Offers and promotions
From time to time we may offer discounts or promotions, such as an offer for first-time direct guests. Each offer is subject to the terms stated with it, including eligibility, booking window, and expiration. Unless the offer says otherwise, offers apply to new direct reservations only, cannot be combined with other offers, cannot be applied to past reservations, have no cash value, and may be changed or ended at any time without affecting reservations already confirmed.
9. Emails and text messages
By giving us your email address or mobile number and signing up, you agree that we may contact you about your inquiry, reservation, and, if you opted in, offers and travel ideas. For text messages: message frequency varies, message and data rates may apply, reply STOP to cancel and HELP for help. Consent to marketing texts is not a condition of booking. Carriers are not liable for delayed or undelivered messages.
10. Reviews and content you share
If you post or send us reviews, photos, comments, or other content, you confirm that it is yours to share and is honest and lawful. You give us a non-exclusive, royalty-free, worldwide license to use, display, and share that content on the Sites and in our marketing, with credit by first name and last initial or another name you choose. We may remove content that is false, offensive, or violates these Terms. We do not pay for or edit reviews to change their meaning.
11. Our content
The Sites and their content, including text, photos, videos, logos, the Swack Vacations name, and design, belong to Swack Vacations LLC or our licensors and are protected by intellectual property laws. You may view and share our pages for personal trip planning. You may not copy, republish, or use our content or brand for commercial purposes without our written permission.
12. Acceptable use
When using the Sites, you agree not to:
- make false, fraudulent, or speculative reservations, or book on behalf of someone without their permission;
- use bots, scrapers, or other automated tools to access the Sites or collect data;
- interfere with the security or operation of the Sites, or try to access systems you are not allowed to use;
- send spam or harmful code; or
- use the Sites in a way that breaks the law or harms others.
13. Third-party services and links
The Sites use and link to services we do not control, such as our booking platform, payment processor, maps, social networks, and local businesses and attractions. Those services have their own terms and privacy practices, and we are not responsible for them. Mentions of restaurants, attractions, and events are suggestions, not endorsements, and their details can change.
14. Disclaimers
We provide the Sites "as is" and "as available." To the fullest extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not promise that the Sites will always be available, error-free, or free of harmful components. Nothing in this section limits any rights you have under your Rental Agreement or under laws that cannot be waived.
15. Limitation of liability
To the fullest extent the law allows, Swack Vacations and its owners, employees, and agents will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from your use of the Sites. Our total liability for any claim relating to the Sites will not exceed the greater of $100 or the amount you paid us for the reservation that gave rise to the claim. Some jurisdictions do not allow certain limitations, so some of these limits may not apply to you. Nothing in these Terms limits liability for our gross negligence, willful misconduct, or anything else that cannot be limited by law.
16. Indemnity
You agree to defend and hold harmless Swack Vacations and its owners, employees, and agents from claims, losses, and expenses (including reasonable attorneys' fees) arising from your breach of these Terms or your Rental Agreement, or from your or your group's conduct at a property, except to the extent caused by our own negligence or misconduct.
17. Governing law and disputes
These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-law rules. If a dispute comes up, please contact us first; most concerns can be resolved quickly and informally. Any lawsuit relating to these Terms or the Sites must be brought in the state or federal courts located in Allegheny County, Pennsylvania, and you and we consent to those courts' jurisdiction. Either of us may bring an eligible claim in small claims court.
18. Accessibility
We want everyone to be able to plan a trip with us. If you have trouble using any part of the Sites, or need information about a property's accessibility features, contact us and we will help you directly.
19. Changes to these Terms
We may update these Terms from time to time. We will post the new version here with a new "Last updated" date. Changes apply from that date forward and do not change the terms of a reservation already confirmed. If you keep using the Sites after an update, you accept the updated Terms.
20. Other terms
If any part of these Terms is found unenforceable, the rest stays in effect. If we do not enforce a provision right away, we have not waived it. You may not transfer your rights under these Terms without our consent. These Terms, our Privacy Policy, our Cookie Policy, and your Rental Agreement are the entire agreement between you and us about the Sites.
